1. Introduction and Acceptance
Welcome to HiMarket (“we,” “our,” or “us”), an online marketplace for buying and selling Magic: The Gathering cards, operated from Hong Kong and available at www.himarket.hk. These Terms of Service (“Terms”) govern your access to and use of the HiMarket website, applications, and services (collectively, the “Platform”).
By creating an account or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Platform.
2. Accounts and Eligibility
- You must be at least 18 years old, or have the consent of a parent or legal guardian, to create an account and transact on the Platform.
- You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
- You agree to provide accurate information when creating your account and to keep it up to date.
- One person may not operate multiple accounts for the purpose of abusing promotions, manipulating prices, or evading restrictions.
- We may suspend or terminate accounts that violate these Terms (see section 9).
3. The Marketplace
HiMarket is a venue that connects buyers and sellers of Magic: The Gathering cards. Cards sold by individual sellers are listed, priced, and described by those sellers. HiMarket verifies cards that pass through our fulfilment process, but listings remain the responsibility of the seller who creates them.
- Listing accuracy: Sellers must accurately describe each card's edition, condition, finish, and language. Materially inaccurate listings may be removed and repeated inaccuracy may lead to account restrictions.
- Condition grading: Condition descriptions follow the grading guidance published in our FAQ. Reasonable, good-faith grading differences are not considered misdescription.
- Counterfeits: Listing counterfeit, proxy, or altered-to-deceive cards is strictly prohibited and will result in immediate account termination. Suspected counterfeits identified during verification are withheld from buyers.
- Prohibited items: Only authentic Magic: The Gathering cards and officially licensed products may be listed.
4. Store Credits
- What credits are: Store credits are a balance on your HiMarket account used to buy cards and pay fees on the Platform. Credits are not a bank deposit, do not earn interest, and are not legal tender.
- Top-ups: Credits can be purchased via our payment processor (Stripe). We never store your full card details — see our Privacy Policy.
- Earning credits: Sellers receive credits when their cards are sold on the Platform.
- Cash-out: Credit balances may be withdrawn (“cashed out”) to a supported payment method (e.g. FPS or PayMe), subject to the cash-out fee schedule published in the FAQ at the time of the request.
- Gift credits: Promotional or gift credits, where granted, can be used to pay platform fees but cannot be used to purchase cards, cannot be cashed out, and may expire as stated in the relevant promotion.
- Non-transferability: Credits cannot be transferred between accounts except through a Platform transaction.
- Errors: We may reverse credits that were added to an account in error, or that result from fraud, abuse of promotions, or reversed payments.
5. Buying, Selling, and Fulfilment
- Orders: When you buy a card, the price in credits is deducted from your balance. An order is complete when the card has been verified and handed over or delivered to you.
- Verification: Cards pass through HiMarket's verification before reaching the buyer. If a card fails verification (wrong card, misdescribed condition, suspected counterfeit), the transaction is reversed and the buyer's credits are returned.
- Fees: Platform fees (e.g. transaction fees, cash-out fees) are disclosed in the FAQ and at the point of transaction. Fee schedules may change prospectively with notice on the Platform.
- Buylist: Where the buylist feature is offered, buylist offers are commitments to buy at the stated price, contingent on the card passing verification, and require sufficient credits at the time of fulfilment.
- Cancellations: Sellers may delist cards at any time before a sale. Completed transactions can only be reversed through the dispute process below.
6. Disputes Between Users
If you believe a card you received was misdescribed or an order was otherwise not fulfilled correctly, contact us at hello@himarket.hk or via WhatsApp within 7 days of receiving the card. We will review the case — including verification records — and may, at our reasonable discretion, reverse the transaction, return credits, or take other corrective action. Our determination of a dispute is final within the Platform; nothing in this section limits any rights you may have at law.
7. Acceptable Use
- No fraudulent, deceptive, or manipulative conduct, including shill bidding, price manipulation, or feedback manipulation.
- No use of the Platform for money laundering or any unlawful purpose.
- No circumventing the Platform to complete off-platform what began as a Platform transaction, where the purpose is to avoid fees or protections.
- No scraping, automated bulk access, or interference with the Platform's operation, except via interfaces we expressly provide.
8. Intellectual Property
Magic: The Gathering, its card names, images, and related marks are the property of Wizards of the Coast LLC. HiMarket is not affiliated with, endorsed by, or sponsored by Wizards of the Coast. Card data and imagery are used for identification purposes in connection with the resale of genuine goods. All other Platform content, branding, and software are the property of HiMarket or its licensors.
9. Suspension and Termination
We may suspend or terminate your account, with notice where practicable, if you materially breach these Terms, if required by law, or to protect the Platform or its users from fraud or abuse. On termination, your remaining store credit balance (excluding gift credits) will be made available for cash-out under section 4, unless the balance is subject to an ongoing fraud investigation or reversal. You may close your account at any time by contacting us.
10. Disclaimers and Limitation of Liability
The Platform is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all implied warranties and are not liable for indirect, incidental, or consequential losses arising from your use of the Platform. Our total aggregate liability to you for claims arising out of these Terms or the Platform is limited to the greater of (a) the total fees you paid to HiMarket in the 12 months before the claim arose, and (b) your store credit balance at the time the claim arose. Nothing in these Terms excludes liability that cannot be excluded under Hong Kong law.
11. Changes to These Terms
We may update these Terms from time to time. Material changes will be announced on the Platform (e.g. via the News page) before they take effect. Continued use of the Platform after a change takes effect constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of the Hong Kong Special Administrative Region. Any dispute arising out of or in connection with these Terms that cannot be resolved through the process in section 6 shall be subject to the non-exclusive jurisdiction of the courts of Hong Kong.
