For the plain-language overview of how consignment works, see Consignment.
These Terms and Conditions (the "Terms") govern the rights and obligations of the seller ("you" or the "Consignor") when using the Magic: The Gathering (MTG) single-card consignment service (the "Service") provided by HiMarket (the "Platform", "we" or "us"). By handing over cards or using the Service you are deemed to have read, understood and agreed to be bound by these Terms.
1. Scope of service and custody
- Scope. The Platform receives, checks, stores and sells your MTG singles through listings on your HiMarket account, collects payment from buyers, and packs and hands over sold cards.
- Ownership. Until a consigned card is sold and handed to the buyer, it remains your property. During the consignment period the Platform acts only as custodian and selling agent.
2. Hand-over, inspection and authenticity
- Inspection. When you hand over cards you must ensure they have no serious hidden defects. On receipt the Platform counts the cards and performs a basic condition assessment. Cards with undisclosed serious damage (such as creases, water damage or heavy wear) or suspected counterfeits may be refused and returned to you.
- Authenticity. You warrant that every consigned card is a genuine product published by Wizards of the Coast. If a consigned card is found, before or after a sale, to be counterfeit, altered or of unlawful origin (such as stolen property), you bear full legal responsibility, must unconditionally refund any related payment received, and must compensate the Platform and the buyer for all resulting losses.
3. Pricing
- Your prices. You set the selling price of each consigned card. The Platform shows market reference prices for guidance only.
- Changing prices. You may change prices at any time through your HiMarket account; changes take effect immediately. If you add HiMarket as a collaborator on your account, the Platform may also adjust your prices on your behalf (for example to keep them in line with the market reference); you may remove that access at any time.
- Orders already placed. An order paid for by a buyer before a price change settles at the price in force when the order was placed. Price changes are never applied retroactively.
4. Fees
- Consignment commission. When a card sells, the Platform deducts a commission of HK$3 + 4% of the sale price from the proceeds. The balance is credited to your HiMarket account as store credits.
- Intake, storage and listing. Free. The Platform does not normally charge for sorting, listing and storing your cards.
- Early-withdrawal fee. Because that work is only recovered when cards sell, if you withdraw cards within 90 days of consigning them the Platform may charge a fee of up to HK$3 per card processed, assessed case by case and payable before the cards are returned. No fee applies to cards the Platform asks you to take back.
5. Account, settlement and withdrawal
- Account information. You can see the status of your consigned listings, your sales record and your available balance in your HiMarket account at any time.
- Settlement. Once a sold card has been pulled and verified by Platform staff against its listing, the net proceeds are credited to your account as store credits and are available immediately.
- Withdrawal. You may withdraw store credits through your account at any time, subject to the Platform's standard withdrawal terms and the 6% withdrawal fee — see Store credits and withdrawals.
6. Retrieving cards and ending the service
- Your request. You may ask to retrieve unsold cards at any time by contacting the Platform. The Platform prepares the cards within 7 working days and notifies you to collect them in store, or mails them to you at your cost. Listings for retrieved cards are removed; any sale completed before the cards are handed back is honoured.
- Termination by the Platform. If the Platform decides to discontinue the Service it will give at least 30 days' notice through the HiMarket website, email or an account message. You may retrieve all unsold cards within the notice period; cards not retrieved by the stated deadline are handled under the Platform's custody and disposal procedure.
7. Loss, damage and limitation of liability
- Duty of care. The Platform takes reasonable care of your cards from receipt until they are handed to a buyer or returned to you.
- Handling errors. If a card is lost or irreversibly damaged in the Platform's custody because of the Platform's own handling (for example misfiling, mis-shipping or damage while pulling it for an order), the Platform compensates you with the net proceeds you would have received had the card sold: the lower of its listed price at the time and the market reference price, less the consignment commission. Compensation is credited to your HiMarket account as store credits.
- Events outside the Platform's handling. The Platform is not liable for loss of or damage to consigned cards caused by events affecting the premises or otherwise beyond its reasonable control, including fire, flood or water damage, theft or burglary, building incidents and force majeure. For such events cards are consigned at your own risk; you may wish to insure valuable cards yourself.
- Overall limit. The Platform's total liability for all cards consigned under one account, on any basis, is limited to the greater of HK$10,000 and the total sale value of consigned cards sold from that account in the preceding 12 months.
- Claims. A claim must be raised within 14 days of the Platform notifying you of a loss or damage, or of you discovering it, whichever is earlier. The Platform does not keep a separate intake record: the cards consigned are taken to be those shown in your HiMarket listings.
- Cards that cannot be located. If a sold card cannot be found, the buyer is refunded, the listing is cancelled without penalty to you, and the Platform contacts you to resolve the matter under this section.
8. Changes to these Terms and governing law
- The Platform may amend these Terms at any time. Amended Terms are published on the HiMarket website; continued use of the Service after publication constitutes acceptance. The version you accepted at enrolment is recorded on your account.
- These Terms are governed by the laws of the Hong Kong Special Administrative Region. Any dispute is subject to the jurisdiction of the courts of the Hong Kong SAR as the court of first instance.
